    1. This information does not therefore contain elements on which to base an argument in relation to the absence of any selective advantage conferred by the disputed measures.

    7. In its evaluation of the information submitted by the United Kingdom in the course of its preliminary investigation, the Commission considered that the relief from the obligation to pay the full amount of corporation tax was liable to confer an advantage on Qualifying Companies. It considered that this advantage was granted via State resources, affected trade between Member States and was selective.
    8. Sweden provided information on the cod catches by a group of vessels fishing in the Skagerrak and Kattegat for Norway lobster with a selective sorting grid as defined in Appendix 2 to Annex III to Regulation (EC) No 43/2009 [2].
    9. In their reply to the Commission request for information dated 12 February 2008, the Hungarian authorities underline that ‘should the Commission still hold that this measure is selective, the measure cannot in any case be considered to be State aid, because selectivity is justified by the nature or general scheme of the system’.
    10. Certainly, states the Court of First Instance, recital 148 of the contested Decision indicates that the Commission considers that the disputed measures are not selective in view of the information submitted by the Kingdom of Spain and Agri–food Cooperatives Spain.
    11. The selective scope of the exemption in question is plain when it is borne in mind that, according to the Commission's information, 80 % of meat and meat products is sold in superstores whose average overall turnover and even their specific turnover on meat is, according to the Commission's information, well above that ceiling [49], while small shops (butcheries), whose average turnover is below the ceiling (FRF 1.6 million), are in competition with the large stores.
    12. Ireland provided information on the cod catches by a group of vessels targeting Nephrops in the Irish Sea with a selective sorting grid similar to that defined in Appendix 2 to Annex III to Council Regulation (EC) No 43/2009 of 16 January 2009 fixing for 2009 the fishing opportunities and associated conditions for certain fish stocks and groups of fish stocks, applicable in Community waters and, for Community vessels, in waters where catch limitations are required [5].
    13. In their reply to the Commission request for information dated 12 February 2008, the Hungarian authorities underline that ‘should the Commission still hold that this measure is selective, the measure cannot in any case be considered to be State aid, because selectivity is justified by the nature or general scheme of the system’. The measure was introduced to diminish certain unfavourable effects that are attributable to the absence of group taxation in Hungary.
    14. The Court found that the Commission, in limiting itself to stating that the aid was selective and reserved to the shipping sector in Sardinia, that more than 90 % of goods transport between the mainland and Sardinia took place by sea and that 65 % of tourist transport (passengers with cars) was carried out by shipping companies, failed to provide any information on the competition between the Sardinian shipping companies and companies established in other Member States.
    15. In the decision initiating the procedure, the Commission made an initial finding, on the basis of the information in its possession, that no selective advantage would be conferred on any specific undertaking or group of undertakings or on any specific activity, given the multipurpose layout of the complex and the obligations imposed on the operator in the lease regarding the nature and promotion of its multifunctional character.
